The couple married in Fiji in 2013 but earlier this year, it was revealed that they had separated.
However, friends of Mr Soffer are now claiming that the pair were never – legally – tied the knot.
A source is quoted by the press as saying Soffer, 47, has been "bragging" that he and 53-year-old Macpherson never legally married.
"It's like Mick Jagger and Jerry Hall all over again," the source added.
In 1999, Hall filed for divorce from the Rolling Stones singer, but Jagger claimed that their Hindu wedding on the island of Bali nine years earlier had not been legally valid. He succeeded in having the marriage ceremony declared invalid, unlawful, and null and void by the High Court in London.
Soffer and Macpherson are said to have started dating in 2012, before tying the knot the following year. In June 2017, the couple separated.
