According to the BBC, in response to the ruling, State Attorney General Wayne Stenehjem said more than one judge should be able to review the legislation, which is thought to be the strictest in America.
The law bans abortion for women after a foetal heartbeat is detected – which can be as early as six weeks into a pregnancy.
Last month, District Judge Daniel Hovland ruled: "The United States Supreme Court has spoken and has unequivocally said no state may deprive a woman of the choice to terminate her pregnancy at a point prior to viability."
In response, Mr Stenehjem told the Associated Press news agency: "The legislature passed the law in hopes that a higher court would revisit the issue.
"It seems prudent that an appellate court should have an opportunity to consider the issue rather than have one judge overturn the judgement of the legislative assembly."
It is thought the case will now be heard at the US 8th Circuit Court of Appeals.
