According to TMZ, the couple – who were married for 10 years – reached an agreement in New York on Wednesday. It is thought the Silverman's have agreed to share custody of their seven-year-old son Adam, while socialite Lauren, who wants to stay in the city to be close to her son, walked away from her marriage with more than $2m.
Earlier this month, a US publication revealed Cowell, 53, was to become a father for the first time after having an affair with his best friend's wife. It has been alleged that the affair began four years ago, and sources close to 36-year-old Lauren have said the couple are still "very much together."
Sources close to Lauren also confirmed that she and Simon, who allegedly began having an affair four years ago, are still "very much together."
The pair were originally said to be planning a move to Los Angeles to raise their baby, but Ms Silverman no longer wants to leave New York because of her son.
It is not yet known whether Simon, who is currently on holiday with friends in St. Tropez in France, will relocate to New York.
The music mogul was reportedly told to "stay away" from his lover until her divorce was settled.
Silverman is due to give birth to the couple's child in February.
