Last week, a US newspaper revealed the 53-year-old music mogul is to become a father for the first time with the New York socialite. However, the relationship has been surrounded in controversy as 39-year-old Ms Silverman is the estranged wife of Cowell's close friend Andrew Silverman.
It has now been alleged that Cowell has been told to "keep his head down" by his lawyer Marty Singer until the Silverman's potentially messy divorce has been finalised.
A source is quoted by the Daily Mirror as saying: " He doesn't want to create any more difficulties than there are already. None of this is easy, but it wouldn't be helped by Simon getting involved at this stage."
Cowell was spotted at One Direction's concert in Las Vegas on Saturday night, but an insider said: "Simon was much quieter than usual, he clearly has a lot on his mind. He went and surprised the One Direction boys though and chatted to them later.
"They were giving him a little light-hearted banter and Simon made some quip about them not following suit and getting girls pregnant.
"He put on a brave face but Simon is in a very dark place. This has all hit him hard. At the moment he just wants to get away from everyone and have some down time."
It has been claimed he will fly out to St Tropez this week to take some time alone.
"The break away may be just the tonic Simon needs," the source added.
