The Finance Minister has published Statutory Guidance on the Forced Marriage (Civil Protection) Act 2007. The 2007 Act allows a Court to make a Forced Marriage Protection Order to prevent a forced marriage from occurring or to offer protective measures when a forced marriage has already taken place.
The Court’s powers are wide and the Orders may contain prohibitions, restrictions, requirements or such other terms as the Court thinks appropriate to stop or change the behaviour or conduct of those who are trying to force the marriage through.
The Guidance is designed to assist with the operation of the 2007 Act in Northern Ireland and to ensure that the protections which the Act offers are widely available.
Sammy Wilson said: "It is generally recognised that forced marriage is an abuse of human rights and a form of domestic abuse. International law states that marriage should be entered into with free and full consent and our own domestic law rightly offers protections against forced marriage.
"I want to ensure that those protections are widely known and properly applied and, with that in mind, I have brought forward Statutory Guidance which sets out the best practice guidelines. Those who exercise public functions in relation to safeguarding must have regard to the Guidance and I believe its publication marks another important step in the drive to protect the health, safety and well-being of any person who is faced with forced marriage or has been forced into marriage."
